Description of service
Forever Loved is an on-demand marketplace that connects customers with independent delivery drivers ("Drivers") to deliver flowers, wreaths, candles, keepsakes, and other tribute items to gravesites and memorial sites in the United States. Drivers provide photo confirmation upon delivery. Forever Loved is a technology platform; we do not own, store, or transport tribute items ourselves.
Driver requirements
- Be at least 18 years of age.
- Hold a valid U.S. driver's license in good standing.
- Maintain current vehicle registration and insurance meeting state minimums.
- Pass a background check covering identity, driving record, and criminal history.
- Own or have authorized use of a reliable, insured vehicle.
- Own a smartphone capable of running the Forever Loved app.
- Maintain a professional, respectful demeanor at all memorial sites.
- Comply with cemetery rules, hours, and posted signage.
Terms of use
You agree to use Forever Loved only for lawful purposes and in accordance with these Terms. You will not (a) impersonate another person, (b) submit false or misleading delivery information, (c) attempt to access another user's account, (d) interfere with the operation of the platform, or (e) reverse-engineer, decompile, or scrape the service.
Terms & conditions
Forever Loved reserves the right to modify these Terms at any time. Material changes will be communicated by email or in-app notice. Continued use of the service after changes constitutes acceptance. Pricing, delivery fees, and mileage quotes are estimates and may be revised before a delivery is accepted. All sales are final once a Driver has been accepted and dispatched, except where required by law.
Customer & driver privacy policy
We collect the personal information you provide (name, email, phone, addresses, payment details) and information generated by use of the service (delivery history, location data submitted with proof-of-delivery photos, device data). We use this information to operate the service, process payments, dispatch Drivers, and communicate with you.
We do not sell your personal information. We share information only with: (i) the Driver or customer party to a transaction (limited to information needed to complete the delivery), (ii) payment processors and other service providers under confidentiality obligations, and (iii) where required by law or to protect the rights and safety of users. You may request access, correction, or deletion of your data by emailing care@foreverloved.app.
App user requirements (while driving, etc.)
Do not use the Forever Loved app while operating a vehicle. Drivers must come to a complete, lawful stop before viewing maps, accepting jobs, taking photos, or marking a delivery complete. You agree to comply with all applicable distracted-driving and hands-free laws. Forever Loved is not responsible for any injuries, damages, or violations resulting from app use while driving.
Driver responsibilities
- Confirm pickup and delivery locations before accepting a job.
- Handle tribute items with care and respect.
- Arrive within the agreed delivery window.
- Place items at the correct gravesite or memorial location as instructed.
- Capture clear, well-lit proof-of-delivery and gravesite photos.
- Promptly communicate delays, obstacles, or issues to the customer through the app.
- Maintain confidentiality of customer information.
Currency (USD)
All prices, fees, and payouts on Forever Loved are denominated and processed in U.S. Dollars (USD).
Affiliates, referrals & third-party links
Forever Loved may use affiliate, referral, and third-party links and services to help fulfill customer requests (for example, florists, cemetery resources, or mapping providers). We may receive a commission or referral fee for some of these relationships. Third-party services are governed by their own terms and privacy policies; we are not responsible for their content, products, or practices.
Compliance with laws
You agree to comply with all applicable local, state, and federal laws, regulations, and ordinances when using Forever Loved, including without limitation traffic laws, cemetery regulations, tax obligations, and consumer-protection laws.
NSF charge ($65)
A non-sufficient funds (NSF), chargeback, or returned-payment fee of $65 USD will be assessed on any payment that fails to clear, in addition to any amounts owed for the underlying transaction.
Mileage source
Mileage estimates displayed in the app are calculated using Google Maps (or comparable mapping providers) for the most efficient driving route between pickup and delivery locations. Actual mileage may vary based on road conditions, detours, and driver routing.
Account termination
Forever Loved may suspend or terminate your account at any time, with or without notice, for conduct that we believe (a) violates these Terms, (b) violates applicable law, (c) is fraudulent, abusive, or harmful to other users, our staff, or third parties, or (d) creates legal exposure for Forever Loved. You may close your account at any time by contacting care@foreverloved.app. Upon termination, your right to use the service immediately ceases. Provisions that by their nature should survive termination (including indemnification, limitations of liability, and intellectual-property rights) will survive.
Intellectual property
The Forever Loved name, logo, app, content, design, layout, code, graphics, and all related materials are the exclusive intellectual property and proprietary rights of Forever Loved and its licensors, protected by United States and international copyright, trademark, and other laws. You may not copy, reproduce, modify, distribute, publish, transmit, license, sell, or create derivative works from any portion of the service without our prior written consent.
Indemnification
You agree to indemnify, defend, and hold harmless Forever Loved, its parent and affiliated entities, and each of their respective officers, directors, employees, agents, representatives, contractors, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, causes of action, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (i) your use of or inability to use the service; (ii) your breach of these Terms; (iii) your violation of any law or the rights of any third party; (iv) any content or information you submit through the service; (v) your interaction with any other user, customer, or Driver; or (vi) any delivery you requested, accepted, performed, or failed to perform. The Indemnified Parties reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate fully with such defense.
Force majeure
Forever Loved shall not be liable for any failure or delay in performance under these Terms to the extent caused by events beyond our reasonable control, including without limitation: acts of God; natural disasters (floods, hurricanes, earthquakes, wildfires, severe weather); pandemics, epidemics, or public-health emergencies; acts of war, terrorism, civil unrest, or government action; strikes or labor disputes; power, internet, telecommunications, or third-party service outages; cyberattacks; fuel or supply shortages; or cemetery, road, or facility closures. During any such event, obligations affected will be suspended for the duration of the event, and Forever Loved will resume performance as soon as reasonably practicable.
